New Health Care-Related Laws Taking Effect This Week

While the Michigan Legislature is currently on a two-week spring break—pausing legislative sessions and committee meetings— many health care-related laws passed in the last session are now officially taking effect this week. These newly enacted health care laws are going into effect as scheduled under the standard implementation timeline, wherein most laws take effect 90 days after the legislative session in which they were passed.

MSMS reviewed and consulted with legislators on each of these measures throughout the legislative process to ensure the physician voice was well-represented.

PA 24 of 2024– Amends the Insurance Code to require insurers to cover mental health and substance use disorders with financial requirements no more restrictive than those for medical or surgical benefits, ensuring parity.

PA 52 of 2024 – Prohibits insurers from requiring health care professionals to provide telemedicine services unless contractually obligated and deemed clinically appropriate by the professional.

PA 54 of 2024 – Requires Medicaid and the Healthy Michigan Program to cover telemedicine services provided at or contracted through approved distant sites as defined in the Medicaid provider manual.

PA 253 of 2024 – Repeals workforce engagement requirements for the Healthy Michigan Plan (HMP) upon approval of a federal waiver.

PA 156 of 2024 – Establishes a one-time, nonrefundable tax credit for live organ donation expenses, up to $10,000.

PAs 51 & 53 of 2023 – Require insurers to provide the same coverage for telemedicine services as in-person care and prohibit Medicaid or HMP from mandating telemedicine over in-person consultations.

PA 39 of 2024 – Updates licensing requirements for dieticians.

PA 251 of 2024 – Removes the requirement for regular donors of self-replicating body fluids to undergo HIV testing every three months.

PAs 231-232 of 2024 – Expand the Administration of Opioid Antagonists Act, allowing agencies and employees to distribute opioid antagonists and authorizing prescriptions and dispensing to agencies.

PAs 244-250 of 2024 – Introduce provisions to enhance maternal health care, including Medicaid coverage for blood pressure monitors for pregnant and postpartum individuals, mandatory mental health screenings during postpartum visits, perinatal facility registration, and hospital requirements for providing newborn insurance enrollment information.

PAs 241-242 of 2024 – Require insurers to cover hormonal contraceptives prescribed and dispensed by pharmacists, establish pharmacist prescription authority for contraceptives, and mandate regulatory rules for implementation.

PA 252 of 2024 – Defines and establishes licensing requirements for freestanding birth centers, with regulations taking effect two years after the law’s enactment.

PA 254 of 2024 – Requires insurers to issue rebates to insured individuals if they do not meet the medical loss ratio as mandated by the ACA.

PA 256 of 2024 – Establishes a doula scholarship program offering financial assistance for doula training to Michigan residents with insufficient financial resources.

PA 255 of 2024 – Prohibits insurers from discriminating against health professionals based on their licensed scope of practice under the Public Health Code.
