RESOLVED: That MSMS work with the state of Michigan to apply Good Samaritan laws in treating indigent patients. RATIONALE: This is one of several resolutions dealing with limiting the liability exposure of physicians who treat patients who are uninsured or are underinsured. As a practical matter the “Good Samaritan Law” already applies to indigent patients and insured patients alike as it is limited to scenarios when a physician or other health professional is a bystander and provides assistance in an emergent or urgent situation. The Committee believed that Resolution 82-10A provides a more comprehensive approach to address the issue of liability immunity for treating the uninsured and underinsured.
