Resolved Section(s):
RESOLVED: That MSMS seek legislation to provide for expert testimony by physicians for and against other health care providers using modern scientifically based guidelines where available and deeper theoretical and clinical training where not yet available. RATIONALE: The Committee understands the intent of the author to protect the public from non-physician health professionals and the risks their lack of training pose to the public. However, the nature of this resolution jeopardizes a cornerstone of MSMS policy as it relates to medical expert witnesses. Under existing law, experts must have matching board certifications in order to testify in a case alleging professional liability. Relying on scientifically based guidelines, as envisioned by the author, could undermine the protections the Michigan expert witness requirements have afforded physicians in this state.
