RESOLVED: That MSMS seek model legislation in Michigan for physicians engaged in disaster relief that provides immunity from civil liability except in instances of willful misconduct and gross negligence.REFERENCE COMMITTEE RATIONALE: The Committee discussed that Michigan already has many of the components necessary to allow physicians to provide care in certain situations that may arise during a disaster. However, it was not certain that the laws that provide immunity for free care and the Good Samaritan laws in Michigan would not be challenged as to their applicability in these situations. Therefore, the Committee concluded that seeking a model law to provide a more clearly defined law that expressly provides immunity during times of disaster could be beneficial.
