RESOLVED: That MSMS ask the Michigan legislature to expand any current Good Samaritan Acts to exempt physicians from liability for free health care given in their offices to the uninsured through participation in a coordinated volunteer program, except in cases of acts or omissions that were the result of willful and wanton misconduct or were intended to injure the patient.RATIONALE: Because the two resolutions dealt with identical subjects, the Committee combined the resolutions. This specific wording for the resolution was selected in order to encompass the desire to legislatively address the need to provide liability immunity for free care provided in physician offices. While the Committee commended the activities of the physicians that participate in Project Access, it was concluded that the resolution should be crafted in such a way as to address this issue in as broad of terms as possible.
