RESOLVED: That MSMS seek legislation to require a separate filling fee for each defendant named in a medical liability suit.RATIONALE: The Committee heard compelling testimony regarding occasions when physicians were wrongfully named in suits simply because attorneys are able to name multiple defendants on a single claim and later remove defendants if they have no involvement in the case. However, this still creates a potential hardship for the physician. Requiring a separate filing fee for each defendant named is a common sense reform to help curtail one of the abuses within the courts. The Committee agreed with the author that this reform would be helpful to physicians.
