RESOLVED: That the Michigan Delegation to the AMA ask the AMA to make every effort to ensure in the implementation of the medical health reform legislation and especially in mental health parity legislation and the State Children’s Health Insurance Program (SCHIP) that patients’ confidentiality be protected – with waivers and opt-out provisions allowed without financial prejudice – so that children and adults can get the medical health benefits they need if they choose to pay for it themselves. REFERENCE COMMITTEE RATIONALE: There is existing AMA policy regarding the right of patients and physicians to privately contract for health care (AMA Policy H-380.989). Additionally, the Committee was concerned that hiding portions of the medical record could endanger the safety of patients, as well as decrease the level of care they could receive without complete knowledge of medical history. MSMS continues to support privacy of medical records. There is existing AMA and MSMS policy on patient confidentiality of medical records.
