RESOLVED: That MSMS work with the Michigan Attorney General’s office to develop and submit specific legislation that will prohibit individuals convicted of domestic violence by a jury for any period of time under any state or local law (including assault and battery, the use or attempted use of physical force, threatened use of a deadly weapon committed by a defendant against a current or former spouse, child, stepchild, domestic partner, and other similarly situated person or family member as defined by the statute) from possessing any firearm for the rest of their lives. REFERENCE COMMITTEE RATIONALE: The Committee recognizes the importance of trying to find appropriate policies to help alleviate the prevalence of domestic violence in Michigan. However, this resolution makes two assumptions that the Committee could not endorse. First, this resolution assumes that persons convicted of misdemeanor domestic violence should be treated identically to felons (persons convicted of felonies are not able to legally possess firearms). Secondly, this resolution assumes that firearms are obtained through legal channels. For these reasons and because the Committee believed that this resolution falls beyond the scope of issues MSMS would typically address. The Committee recommends no action.
