RESOLVED: That the Michigan Delegation to the AMA ask that our AMA work with the federal government and regulatory agencies to ban direct to consumer marketing of durable medical equipment such as scooters, and to institute substantial penalties to suppliers; and be it further.RESOLVED: That the Michigan Delegation to the AMA ask that our AMA work with federal authorities to stop the circulation of “letter of approval” for scooters to the Medicare participants, which is a fraudulent practice.RATIONALE: The Committee was informed that AMA has existing policy pertaining to durable medical equipment (DME) requirements (H-330.945). Additionally, the Committee learned that DME is under scrutiny by CMS as evidenced by a bidding pilot program in select geographic areas where one or more DME companies will be designated as in-network DME suppliers. Finally, the Committee was concerned about restrictions on free speech.
